Woman, Man Die in Separate Single-Vehicle Accidents

A woman and man were killed in separate single-vehicle accidents this weekend, according to news reports. The woman, 51-year-old LaJuanda Coleman, was driving along Avenue W in Birmingham Thursday morning when she lost control of her SUV and hit a utility pole. The man, 43-year-old Daniel Dalessandro, was killed when his Harley Davidson motorcycle crashed in Elmore County on Sunday night. The motorcycle was the only vehicle involved in the crash. The causes of the crashes have not yet been released.

When a loved one is killed in a single-vehicle accident, friends and family members may believe that the crash is a tragic accident for which no one is at fault. That is not always true, however. Some single-vehicle accidents may be caused by a defective automobile or its component parts. In these cases, the manufacturer of the defective product may be held liable for your loved one's death.

If you believe a product manufacturer may be responsible for your loved one's death, call the Birmingham wrongful death lawyers at 1-877-925-5373 for a free consultation regarding your case. Mother Sues Crib Maker Over Infant Death

A mother filed a wrongful death suit in Florida last month against Simplicity, Inc., the manufacturer of the defective crib that killed her two-year-old daughter. In September 2007, the toddler's head got stuck in the frame of the drop-side crib, causing the child to suffocate. The company recalled the crib just two days after the child's death. The recall involved over one million Simplicity and Graco cribs that were defectively designed.

When a person dies as a result of a defective product, the manufacturer of the product may be held liable if they were negligent in manufacturing or marketing the product, and that negligence caused injury or death to consumers. In products liability actions, wrongful death suits are filed by the victim's surviving family members against the product's manufacturer for the defective design, marketing, or labeling of the product. Wrongful death suits allow victims' family members to hold negligent manufacturers liable for their loved one's death and to receive compensation for the emotional and financial losses suffered as a result of the death.

Watson Pharmaceuticals Recalls Fentanyl Pain Patch

Watson Pharmaceuticals, Inc. has issued a voluntary recall of its generic 100 mcg/hr fentanyl pain patch. A manufacturing error may cause the patches to leak fentanyl gel, potentially resulting in overdose, respiratory depression, or even death. The company announced on Friday a recall for 100 mcg/hr fentanyl transdermal system patches shipped in the United States between April 2 and May 20 of this year. The patches have the lot number 145287A located on the box or on the patch itself. The company warned that any patches covered by this recall should not be handled directly. Consumers who purchased the patches can call 888-345-2656, Monday through Friday, 8:00 a.m. to 5:00 p.m. EDT, for instructions on how to return the defective product.

This is a classic example of a products liability case, in which the manufacturer of a product may be held liable if they were negligent in manufacturing or marketing the product, and that negligence caused injury or death to consumers. If you have lost a loved one because of a defective fentanyl pain patch, you are entitled to seek recovery for your loss. A Birmingham wrongful death lawyer can help you get compensation for your loss and prevent future deaths and injuries that may result from the defective patch.

Family of Woman Who Died on Waiting Room Floor Settles for $2 Million

The family of Esmin Green, the woman who died after lying prone on the floor of a hospital waiting room for over an hour, settled their wrongful death case with the City of New York late last month for $2 million. On June 19 of last year, Green slumped to the floor of Kings County Hospital in Brooklyn after having been made to wait for 24 hours without seeing a doctor. Two security guards and a doctor had wandered in and out of the waiting room during the hour that Green lie dying, but no one checked to see if she was alright until it was too late.

Cases like this engender public outrage and highlight the importance of wrongful death cases. In a case like this, family members want to see that the people responsible for their loved one's death are brought to justice. Egregious conduct such as that displayed by the hospital's security and staff in Esmin Green's case should not go unpunished. If you have lost a loved one due to the wrongful conduct of another, contact a Birmingham wrongful death lawyer to explore your legal options.
